WAIVER/RELEASE OF LIABILITY

By presenting a Humber College Membership card, Student Card, Staff Card, Residence Card, ONE Card, or accessing a Humber Athletics Building the user acknowledges and accepts all terms and conditions outlined regarding Policies, Guidelines, Rules, Negligence, and Waivers therein. 

GENERAL POLICIES

Please always follow the direction(s) of the Humber Athletics Staff. Should you have any questions please ask.

Etiquette and Expectations
  • All patrons are to follow the dress code and be mindful of other patrons using the fitness centre.
  • As part of our scent-free policy we expect clothing to be reasonably fresh.
  • If You Use Scented Products: Use them sparingly. A general guideline is that the scent should not be detectable more than an arm’s length away from the user. Consider using unscented alternatives.
  • Please return all weights or other equipment to their proper place after use.
  • Use care with all exercise equipment.
  • Please do not drop or bang dumbbells, barbells or weight stacks.  
  • Use control when lifting and lowering weights.
  • Do not remove equipment of any kind from the program or designated areas.
  • Share equipment - be mindful of prolonged use of any equipment.
  • No outside equipment may be brought in except for bands - we reserve the right to deny personal equipment into the fitness centre that may pose a potential risk to our equipment or the safety of others.
  • Do not add weight plates to the pins of weight stacks.
  • Ask for help if unsure how to use a piece of equipment. 
Proper Equipment Use
  • If you are unfamiliar with equipment and machines, please ask staff for assistance.
  • Refrain from using weights on cardio machines.
  • Avoid bouncing or dropping weights and weight stacks.
  • For the safety of everyone, clips must be used on barbells regardless of weight.
  • Be mindful of other facility members regarding sharing equipment and spaces.
  • Machines must be used for the specified design.
Equipment Clean Up
  • Members are required to clean each machine after use and dispose of wipes in the trash.
  • Please wipe down and put all equipment away after use.
Proper Fitness Attire/Dress Code 
  • All patrons must change in a changeroom
  • Proper gym attire - including shirts/tops - is to be always worn in the Fitness Centre and studios.
  • Street clothes or jeans are not permitted while using fitness areas.
  • Dry, closed-toe athletic shoes are required at all times.
  • Dress shoes, boots, Crocs, slippers, Uggs, sandals, slides or open-toed shoes are not permitted.
  • Please leave all your personal belongings securely locked in a locker in the changeroom or in one of the lockers conveniently located on the fitness centre floor.
  • Gym bags are not permitted on the floor. Bring your own quality lock.
  • Humber College Department of Athletics is not responsible for lost or stolen items.
Prohibited Items/Behaviours
  • Filming/photography or digital recording unless approved by Management prior to recording.
  • Personal speakers - please use headphones to not disturb other patrons.
  • Sports equipment - including but not limited to basketballs, soccer balls, volleyballs, etc.
  • Food or drinks other that water.
  • Powdered chalk
  • Sparring or other MMA style training
  • Bags, books, coats, etc on the floors - please use day use lockers.
  • Haircutting is not permitted in any of the Athletics buildings or areas.
  • Personal Trainers who are not actively employed by Humber College Athletics are not permitted to train clients in the Facility, this includes virtual training.
  • Disruptive or abusive behavior towards Staff, other Clients, or equipment will not be tolerated and may result in removal from the building(s).
  • Misuse of fitness equipment.
  • Failure to abide by Athletics Policies may lead to suspension of privileges without compensation or refund. 
Group Fitness Classes
  • All group fitness classes are first come, first served for space and equipment.
  • We reserve the right to limit numbers within the studio for a particular class.
  • Bounce classes require you to reserve boots if you need them which can be done at the cardio room desk - failure to show up within 10 minutes of the class start time will result in the boots being given to another participant.
  • Be mindful of classes already in session - we reserve the right to deny entry to any class after it has begun.
  • Entry to the studio for any other purpose other than participating in the class is strictly prohibited.  
  • Proper gym attire must be worn in all fitness classes - no outside shoes/boots, jeans, etc.  Barefeet is permitted within specific classes.
Community Members
  • Proof of full COVID vaccination is required at the time of purchase. (Ontario QR code or hard copy print required = will be scanned)
    Proof of vaccination exemption will be subject to review by Humber College Management and membership(s) will not be available until reviewed and approved. 
  • Memberships are sold in person only. Buying for significant others, or online purchases are unfortunately not available at this time. Individuals must come on-site to purchase a membership.

MEMBERSHIPS 

  • Humber Athletics will no longer offer ‘Holds’ on Fitness Centre Memberships. 
  • Humber College Department of Athletics will be closed for all statutory holidays, as well as an extended period during December/January. Athletics may close periodically for special events/training. An additional two weeks will automatically be added to any membership purchased over the December College dates to accommodate these closures. No reimbursements will be granted for these dates. Extra dates will not be issued to memberships that do not extend over the December closures. 
Fitness/Personal Training Appointments 
  • Twenty-four hours’ notice must be given when canceling or rescheduling any appointments. Failure to notify your trainer will result in the loss of that session from your package. 
  • No refunds will be offered two weeks after the commencement of the first session booked. 
  • If a refund is granted, you will receive reimbursement for the remainder of sessions not used from the package, less a $25.00 service fee. 
  • All Personal Training Sessions expire one (1) year from the purchase date. 
  • Student Personal Training Sessions expire at the end of the term of enrollment. Proof of enrollment must be shown for all student rate packages. All sessions must be used during the Student Enrollment period. Purchased (student-priced) sessions may only be used while actively enrolled.
  • If you are returning in the fall semester and are not enrolled in summer classes, you may use your sessions but must purchase a student summer membership. 
Refunds 

Humber College Athletics endeavors to create a welcoming atmosphere for all user groups. Should you require a refund each case will be considered on an individual basis. All refunds are subject to an Administration Fee of $25.00.  

  • Refunds for memberships will only be offered within 14 days (two weeks) of commencement/payment of the membership and must be requested in writing or in person.
  • Membership refunds not requested in writing or in person within 14 days (two weeks) of commencement/payment of the membership will not be issued. These funds will be forfeited and no credit or value will be reassigned. 

*Members who have Athletic privileges revoked for behavioral or policy noncompliance reasons are not eligible for reimbursement for fees or time lost.

Parking 

Humber College Athletics, in conjunction with Humber's Transportation and Parking Services department, is authorized to sell parking to community members. Please inquire when purchasing your membership in the main Athletics Office A116.

  • Athletic parking will only be offered at the time of sale.
  • Purchase is limited to community members (Humber staff and students are not eligible) and use of the parking pass is limited to the purchaser only.
  • Athletic Parking users must abide by Humber's parking regulations which can be found here.
  • Any user found to be in violation of Athletics and Humber's regulations will have their pass revoked with no refund offered.

COVID POLICIES

Our number one priority is to offer a SAFE and ENJOYABLE exercise experience. Should you have any questions please ask one of our super-friendly Staff Members

Mandatory
  • If you do not feel well – DO NOT COME ON SITE.
  • Please arrive and present your Membership Student Card, Residence Card or Staff Card.
General
  • Please ensure you wipe down ALL equipment BEFORE and AFTER use.
  • Day Use Lockers are available – please bring your own lock and follow directions upon arrival.
  • Wash your hands frequently throughout training and avoid touching your face.
  • Our clients are our greatest resource in maintaining a SAFE, HEALTHY, and ENJOYABLE experience. It is important that WE ALL do our part. 

REFUND POLICY - CLOSURES 

Closures due to COVID or other significant health reasons 

Should the need arise for Humber College Athletics to suspend operations due to Covid or any variant thereof, the following will occur:

1-30 Days closed 
Should Humber Athletics be subject to a forced closure, dates owed would be calculated in trust and credited towards a daily total. These dates (up to 30 days) will be re-assigned to the individual at the end of their expired membership and credited on the renewal of membership.  
Credits (days owed) are non-transferable from one individual to another.  

31-90 Days 
Should Humber College Athletics be closed for more than 30 days Members will be issued a full refund as calculated on a daily rate. Athletics will not be able to hold or continue to accrue dates beyond 31 days. Members will be refunded by the original method of payment (credit or debit card). Credits are non-transferable from one individual to another. 

90+ Days (**NEW**
Membership Refunds not requested in writing or in person after 90 days of a forced closure will not be issued.  These funds will be forfeit and no credit or value will be reassigned. 


WAIVER OF LIABILITY FOR ALL CLAIMS AND RELEASE OF LIABILITY 

PLEASE READ CAREFULLY: 

The Participant and/or the Participant’s Guardian understands and acknowledges, the risks, dangers, and hazards which are inherent on entering all lands, properties, facilities, structures, installations, vehicles or equipment owned, leased, operated or otherwise controlled by the Humber College / Organization (the “Premises”), which risks include, but are not limited to: the potential for bodily injury or illness (including contraction of COVID-19); contact or interaction with others who may have been exposed to COVID-19; close proximity to or contact with surfaces, equipment, fixtures, or other objects that, despite the Organization’s efforts, may be infected with COVID-19 or other communicable illnesses; permanent disability, paralysis, or loss of life; collision with natural or manmade objects; tripping hazards; imperfect venue or field of play conditions; equipment failure; participants of varying skill levels; the negligent use of the Premises by others; inadequate safety measures or unsafe Premises; other circumstances known, unknown or beyond the control of the Organizer, its partners, sponsors, agents, affiliates, directors, employees, officers, therapists, or volunteers (together, the “Releasees”); or negligence or omission of the Releasees (collectively, the “Risks”). 

In consideration for allowing the Participant to use the Premises, the Participant and/or the Participant’s Guardian: (a) release, discharge and forever hold harmless the Releasees from any and all liability for damages or loss arising as a result of the Risks arising from entry into or use of the Premises; (b) waive any right to sue the Releasees in respect of all causes of action (including for injuries or illness caused by their own negligence), claims, damages or losses of any kind that may arise as a result of the Risks or in connection with entry into or use of the Premises, including without limitation the right to make a third party claim or claim over against the Releasees arising from the same; and (c) freely assumes all risks associated with the Risks or anything incidental to the Risks, which may arise as a result of or in connection with use of the Premises. YOU ARE GIVING UP LEGAL RIGHTS TO ANY AND ALL FUTURE CLAIMS AGAINST THE ORGANIZATION AND RELEASEES.
